What are the legal ages for cannabis possession and cultivation?
In the state of Texas, the legal age for possession and cultivation of cannabis is 21. Under Texas law, an individual must be at least 21 years old to legally obtain, possess, consume, or cultivate cannabis. Individuals under the age of 21 are prohibited from purchasing, possessing, consuming, or cultivating cannabis, and doing so would be considered a criminal offense. The Texas Compassionate Use Act (TCUA) of 2015 permits an individual of any age who suffers from a debilitating medical condition to possess and consume cannabis as prescribed by their physician. As of September 2018, the only medical conditions that qualify for use of cannabis under the TCUA are intractable epilepsy and multiple sclerosis. In 2019, a bill was introduced in the Texas legislature to decriminalize possession of small amounts of cannabis, and to reduce the penalty for cannabis possession from a Class B misdemeanor to a Class C misdemeanor. The bill did not go up for a vote before the session ended, and it is not expected to be reintroduced in 2021. Overall, cannabis possession and cultivation is illegal in the state of Texas for individuals under the age of 21. For those individuals suffering from a qualifying medical condition, the state has legalized cannabis use as a medical treatment.
