Are there any laws that govern where cannabis can be grown?
In Texas, cannabis cultivation and production is strictly regulated. Generally, growing cannabis is illegal in the state; however, there are a few exceptions to this rule. The Compassionate Use Act of 2015 established a program for people with intractable epilepsy to receive low-THC cannabis extracts, which must be obtained from an in-state source. This program allows qualifying medical cannabis patients to receive cannabis oil with 0.5% or less THC from an in-state dispensary. Additionally, Texas has authorized research institutions to grow cannabis for research purposes. In 2017 the Texas Department of Public Safety approved the first medical cannabis grower, Cansortium Texas, to grow and process low-THC cannabis. Lastly, Texas law prohibits anyone from growing cannabis on their private or public property, with the exception of research institutions. This means that aside from a few exceptions, citizens of Texas cannot legally grow cannabis on their property. In conclusion, there are laws and regulations that govern the cultivation of cannabis in Texas. Patients with intractable epilepsy and certain research institutions may be sanctioned to grow cannabis, but it is generally prohibited for the rest of the population.
