Is it legal to use cannabis in a federal park?

In Delaware, using cannabis in a federal park is illegal. Cannabis is federally illegal under the US Controlled Substance Act, so using cannabis in a federal park is prohibited. Cannabis is also illegal under Delaware state law, which means that even if the federal government were to change its stance, Delaware law would still forbid cannabis use in a federal park. The penalty for possession and use of cannabis in a federal park would be a misdemeanor with a maximum sentence of up to one year in prison, a fine of up to $1000, or both. Additionally, federal law enforcement officers can file federal charges if they catch somebody using cannabis in a federally maintained park. It’s important to note that Delaware’s cannabis laws are in the process of changing. Delaware recently legalized the possession and use of cannabis for recreational purposes, but this law does not extend to federal parks. Even though using cannabis in a federal park is illegal, the movement to change cannabis laws around the country continues to grow. As these laws are revised, we can hope that laws banning cannabis use in federal parks will be reconsidered in the future.
