Are there any restrictions concerning cannabis cultivation on private property?
In Texas, private property owners are not legally allowed to cultivate or produce cannabis or cannabis products on their land. The only way to cultivate cannabis in Texas legally is to obtain a license from the Texas Department of Public Safety (DPS). This license would allow a person to produce medical cannabis as part of an approved program. The only other places where cannabis cultivation is allowed is on college campuses for research purposes. The University of Texas at El Paso (UTEP) is one of the only universities in the state that is allowed to grow and study cannabis for medical research. However, this research is strictly regulated and monitored by multiple government agencies. The use of cannabis in Texas is still illegal under state law and the penalty for cultivation continues to be a felony. Although there are some legal exceptions for medical use, the cultivation of cannabis is not something that is allowed on private property in Texas. Furthermore, the possession and sale of cannabis are both still felonies and can result in jail time. Therefore, it is important for all Texans to be aware of the current laws and regulations concerning cannabis, even if only growing for personal use.
