Yes, there are age requirements for purchasing cannabis products in Delaware. The legal age to purchase, possess, and consume cannabis and cannabis products in Delaware is 21 years old. Individuals must be 21 years old to purchase cannabis products from a licensed retailer or to receive and possess up to one ounce of cannabis flower and five grams of cannabis concentrate. Any individual caught breaking the law by providing cannabis products to someone under the 21 years of age may be subject to a misdemeanor offense. If a minor is found in possession of any amount of cannabis they may be subject to a penalty of up to $575 for the first offense. Subsequent offenses may result in up to 30 days of jail time and/or other penalties. It is also illegal to sell or provide cannabis products to anyone under 21 years of age, even when no money is exchanged. This could include gifting, trading, or giving away cannabis products. Doing so could result in a possible misdemeanor with a maximum sentence of 6 months in prison and/or up to a $1,150 fine. These laws are in place to protect minors from the potential effects of consuming cannabis, as it can have adverse effects on minors. For this reason, all cannabis-related businesses in Delaware are required to verify the age of their customers before making a sale.
