Yes, there are restrictions on the use of cannabis for medical purposes in Virginia. In March 2020, the Virginia General Assembly passed House Bill 1251, which legalized the use of medical cannabis oil for the treatment of certain medical conditions, such as cancer, Crohn’s disease, Multiple Sclerosis, and Post Traumatic Stress Disorder. However, medical cannabis oil is only available to those with specified medical conditions, and only with a written prescription from a registered medical practitioner. While House Bill 1251 allows for the manufacturing, dispensing, and possession of medical cannabis oils, it does not permit the smoking or vaporizing of cannabis. Furthermore, only those 18 years of age or older are allowed to purchase or possess medical cannabis oils. Those younger than 18 may only use medical cannabis oils with a written recommendation from two doctors and a parental consent form. Additionally, it is important to keep in mind that all of the legal restrictions of cannabis remain in place in Virginia. Even with a valid medical cannabis oil prescription, it is still illegal to possess, grow, buy, or use cannabis in any form other than medical cannabis oil. Possession of any amount of cannabis for recreational use remains a criminal offense, with serious penalties.
