Yes, there are laws concerning the production and sale of cannabis products in California. In 2016, California passed the Adult Use of Marijuana Act. This law, also called Proposition 64, allows adults 21 and over to possess, transport, and use up to one ounce of cannabis for recreational purposes. Additionally, businesses must be licensed to produce and sell cannabis products. Retailers must acquire a license from the state’s Bureau of Cannabis Control (BCC) in order to legally operate in the state. The BCC administers the licensing, regulation, and enforcement of all commercial cannabis activity. In order to become licensed, a retailer must meet certain requirements, such as paying a licensing fee, completing a background check, and following all pesticide, product, and labeling regulations. Businesses must also submit to annual state-mandated independent testing to verify that their products meet the state’s safety standards. Retailers are not allowed to sell products to minors, or to distribute cannabis through any type of drive-thru or vending machines. Cannabis remains illegal under federal law, so producers, sellers, and users must continue to follow state regulations and laws in order to remain compliant. Violating these laws may result in severe civil and criminal penalties.
