Yes, there are laws concerning the production and sale of cannabis products in Kansas. In Kansas, cannabis is classified as a Schedule I controlled substance, which means it is illegal for any person or business to possess, cultivate, distribute, or sell cannabis or cannabis-infused products. Possession of cannabis is a misdemeanor punishable by up to one year in jail and a fine of up to $2,500. Kansas does, however, currently allow for the production and sale of low-THC cannabis oil for medical purposes. The state has passed the Alternative Crop Research Act, which allows for the use of CBD oil containing less than 0.3% THC for medical purposes. In order to be able to purchase CBD oil, patients must obtain a written certification from a physician registered with the Kansas Department of Health and Environment. Additionally, a state law that was recently passed in 2020 allows certain hemp-derived products to be legally purchased, possessed, and consumed in the state, including hemp-derived CBD oil. However, a person must be 18 years of age or older to purchase any hemp-based products. For non-medical cannabis products, Kansas has not yet legalized any production or sale within its borders.
