What is the process for filing a writ of certiorari?

Filing a Writ of Certiorari is a legal process used to challenge the decision of a lower court in the state of Virginia. The writ is filed with the Supreme Court of Virginia and must be granted in order to move the case forward. In order to file a Writ of Certiorari, the applicant must first file a Petition for Appeal with the Supreme Court of Virginia. The petition must include information about the case, why the applicant believes there was an error in the lower court’s ruling, and what relief is sought. The petitioner must also provide a copy of all the relevant court documents and a certificate of compliance from the circuit court. After the petition is filed, the Supreme Court of Virginia will review it and decide whether or not to grant the Writ of Certiorari. If granted, the case will be transferred to the Supreme Court and a brief will be prepared by the applicant. The brief must include information about the facts of the case and the legal arguments supporting the petitioner’s position. The respondent will also be notified and will be given the opportunity to submit a response brief. The Supreme Court of Virginia will then review the petition, briefs, and record before deciding whether or not to grant the writ. If granted, the case will be heard by the Supreme Court and a decision made. If the writ is denied, the original lower court ruling will stand.
