What is the difference between a workers’ compensation claim and a catastrophic injury claim?

In Indiana, a workers’ compensation claim and a catastrophic injury claim have many similarities, but are also very different. Both types of claims are designed to provide financial support to those who have been injured as a result of an accident or injury in the workplace. A workers’ compensation claim is intended to cover any medical expenses related to an injury or condition suffered in the workplace, including long-term care costs, lost wages and other benefits. Depending on the severity of the injury or condition, the injured employee may also be eligible for disability benefits. In most cases, an injured employee does not have to prove that anyone was at fault in order for a workers’ compensation claim to be successful. In contrast, a catastrophic injury claim is much more difficult to prove and requires the injured individual to demonstrate that someone else was directly responsible for the injuries suffered. This means that the injured person must prove that another party’s negligence or recklessness was a major contributing factor in the accident that caused the catastrophic injury. Certain types of accidents, such as those involving defective products, motor vehicle accidents, and medical malpractice, can all be potential sources of catastrophic injury claims. Such claims are much more complex than those for workers’ compensation and can involve a variety of medical, legal, and financial considerations. In summary, a workers’ compensation claim is designed to provide financial support to those who are injured in the workplace, whereas a catastrophic injury claim requires more evidence and involves proving that someone else was responsible for the injuries suffered.
