What is a liens and can I dispute it?
A lien is a type of legal claim made against a person or their property, usually for unpaid debts. When a lien is in place the person cannot sell or transfer their property until the lien is removed. In South Carolina, a lien may be placed on your credit card debt if you fail to pay the balance. This lien allows the lender to seize your assets, like a car or home, to pay off the debt. You can dispute a lien with the lender or in court. The South Carolina Credit Card Dispute Resolution Law requires the lender to respond to your dispute and give you a timeline for resolving the dispute. If the dispute is successful, the lender must remove the lien. Otherwise you can choose to take the dispute to court. In court, you can argue that the lien is unjustified or that the lender has violated the terms of the credit agreement. If you choose to challenge the lien in court, you may be able to recover some of your legal fees. This means the lender would cover some of the costs you incurred while preparing your case and arguing it in court. It is important to remember that disputing a lien can be a lengthy and costly process. Consult a legal professional to understand your options and to ensure your rights are protected in the process.
