What is the Fair Debt Collection Practices Act?

The Fair Debt Collection Practices Act (FDCPA) is a federal law that protects consumers from unfair and abusive debt collection practices in the United States. The FDCPA applies to all consumer debt collection activities, including credit card debt collection activities in Delaware. The FDCPA prohibits debt collectors from engaging in harassing or deceptive practices such as calling a debtor at unreasonable times or trying to collect on a debt that the consumer does not legally owe. The law also requires debt collectors to provide the consumer with information about the debt, the identity of the debt collector, and the methods used to collect payment. Additionally, debt collectors are prohibited from using abusive language or threatening a lawsuit or repossession. The FDCPA also establishes certain requirements that debt collectors must adhere to when collecting credit card debts in Delaware. For example, debt collectors must provide the consumer with notice that the debt is being disputed and must stop all collection activities if the consumer disputes the debt in writing. Additionally, all communication from the debt collector must include specific information, and any payment arrangements must be in writing. Finally, debt collectors are prohibited from making false or misleading representations about the debt, the amount owed, or the consequences of not paying.
