Can a debt collector contact me at my place of employment?
In California, a debt collector cannot contact you at your place of employment unless they have your written consent or they are responding to a legal process. The state has stringent rules prohibiting debt collectors from contacting you at your place of employment in order to collect a debt. According to the California Consumer Debt Defense Law, a debt collector must not "communicate with the debtor at any unusual time or place or a time or place known or which should be known to be inconvenient to the debtor." In addition, debt collectors cannot leave messages with your employer regarding the debt and they cannot contact your employer directly unless they have a court order. If you receive notice from a debt collector that they intend to contact your employer, you can contact an attorney or contact your local legal aid office for help. In short, debt collectors cannot contact you at your place of employment in California unless you provide written consent or they have a court order. If a debt collector contacts you at work, you can contact a lawyer or legal aid office to get help.
