What is collection defense law?

Collection defense law is a legal framework in Texas that allows consumers to protect themselves against debt collection practices that violate state and federal laws. Collection defense law provides consumers with protections against debt collectors. Debt collectors are not allowed to harass, threaten, or oppress consumers, and any debt collection practices that violate state or federal law can be challenged in court. Collection defense law requires that all debt collectors provide consumers with a written statement detailing the amount of the debt, the creditors name, and how to dispute the debt. Debt collectors are also prohibited from using false or misleading statements to collect a debt. Additionally, debt collectors must identify themselves as a debt collector when communicating with debtors. Collection defense law also protects consumers from being sued in court for debt collection. In order to sue a consumer in court, a debt collector must first provide the consumer with a valid summons or a court order. Finally, collection defense law protects consumers from wage garnishment and other illegal debt collection practices. Debt collectors are prohibited from taking any money out of a consumer’s bank account or wage without first receiving a court order. Additionally, consumers are allowed to dispute debts by raising objections within 30 days of receiving a court order.
