What is a debt validation notice?

A debt validation notice is a document sent to consumers in the state of Maryland before a debt collection agency can take legal action against them. This notice is required by the Maryland Collection Defense Law and must include the debt amount, name of the creditor, and the debtor’s rights to dispute the debt or request validation of the debt. The law requires debt collectors to provide this document in order to give debtors a reasonable opportunity to challenge the debt or ask for proof that it is valid. In other words, a debt validation notice provides debtors with the chance to dispute the debt if they believe it is not owed by them. If the debt collector believes the debt is valid, they must provide evidence of its validity. This may include copies of past due invoices, official documentation from the original creditor, and other documentation. In cases where the debt is found to be invalid or unenforceable, the debt collector cannot take any further action to collect the debt. Receiving a debt validation notice is an important step in the debt collection process and can provide consumers with important information needed to dispute the debt. It is important to read the notice carefully, understand the rights provided by the Maryland Collection Defense Law, and follow up with the creditor and debt collector if necessary.
