How can I modify a child custody agreement?

In Washington, a child custody agreement can be modified if there is a substantial change in circumstances. A "substantial change in circumstances" includes changes that affect the health, safety, or welfare of the child, or a significant change in the needs or circumstances of a parent or guardian. If there are changes to the agreement, the parties must submit a proposed modification to the judge in their family law case. In Washington, this is done by manufacturing a Petition to Modify Custody. In the petition, the party must explain why the agreement should be changed and how the proposed change is in the child’s best interests. The opposing party must then be served with the Petition and given a chance to respond. If the parties cannot agree on a modification, the judge will consider both sides and make a decision. The court will also consider any facts that are presented and allow each party to present witnesses and other evidence. The judge may also consider expert witnesses, such as psychologists, to provide their opinion on how the proposed modification may affect the child. Ultimately, the judge will review all evidence and make a decision about whether the modified agreement is in the best interest of the child. If the judge approves the proposed modification, then the agreement will be changed.
