What are the rights of a custodial parent?
In Virginia, a custodial parent is a parent who has been given the right to have physical and/or legal custody of a child. Under Virginia law, custodial parents have the right to make decisions about the child’s health, education, and welfare. The custodial parent also has the right to receive financial support from the non-custodial parent. This includes child support payments, which are used to cover the costs associated with raising a child such as healthcare, housing, food, and clothing. The custodial parent also has the right to establish rules and expectation for the child, provide guidance and instruction, and to retain control of the child. A custodial parent also has the right to determine where the child will live and to spend time with the child on a regular basis. The courts in Virginia may also grant the custodial parent parental responsibility for the child, which requires them to make decisions about the child’s schooling, healthcare, and religious or moral education. The custodial parent also has the right to be involved in court proceedings concerning the child such as child custody, child support, and visitation. If the custodial parent is denied the right to be involved in court proceedings, the court may order that a different parent take legal action on behalf of the child. Ultimately, being a custodial parent in Virginia means having the right to protect and nurture the child’s best interests.
