What is the process for enforcing a child support order?
Enforcing a child support order involves several steps in Washington. First, the custodial parent must file a request for payment with the court that issued the order and provide proof of non-payment. This proof could include copies of cancelled checks or bank statements. Once the court is in receipt of the request, the non-custodial parent will be notified and has thirty days to respond. If the non-custodial parent does not respond or comply with the request for payment, the court may issue a wage garnishment order. This order would require the employer of the non-custodial parent to take a specified amount from their paycheck and give it directly to the custodial parent. However, the employer must be given at least thirty days’ notice before they are required to garnish wages. The court may also take other legal action to enforce the child support order, such as suspending the non-custodial parent’s driver’s license or professional license, or possibly placing liens on their real estate or other personal property. If the parent is in arrears of more than one payment, the court may hold them in contempt. If found guilty, the court may sentence the parent to jail time. Finally, in Washington, the Child Support Services Division is available to assist both the non-custodial and custodial parents in enforcing the child support order.
