Resolving disputes in China is governed by the China Business Ventures Law, which provides guidance to entrepreneurs, investors, and businesses that operate in China. This law states that disputes must first be resolved through direct negotiations between the parties involved in the dispute, in order to prevent any further damage or loss to either side, and resolve the dispute in a timely manner. In the event that negotiations are unsuccessful, the law provides that the parties must then attempt to resolve the dispute through mediation. Mediation involves the use of a third party mediator who helps the parties reach a mutually agreed upon solution. If the two parties are unable to agree, the parties may take their dispute to a Chinese court for resolution. The court may render a decision or settlement, or the parties may come to an agreement in court that is legally binding. Finally, if the parties are still unable to resolve their dispute, they may seek to resolve the dispute through arbitration. This is a process whereby the Chinese government, or an international arbitrator, is asked to review the case and make a binding decision.
