What laws govern advertising in China?
In South Dakota, the laws governing advertising in China are established by the China Business Ventures Law (CBVL). The CBVL is a law enacted by the Chinese Government to regulate both foreign-invested and domestic commercial activities. The law states that all advertising must comply with the laws of the People’s Republic of China and must not cause harm to public interest or public morals. The CBVL also stipulates that companies must not use their advertising to misinform, deceive, or cause any kind of confusion. Companies must make sure that their products and services are accurately described in their advertisements to ensure that buyers know what they are purchasing. Furthermore, advertising must not use any discriminatory language that violates the rights of other individuals or ethnic groups. The CBVL also requires companies to be ethical in their advertising activities. Companies are prohibited from using false claims or exaggerated language that could mislead customers or damage their interests. Companies must also ensure that their advertising provides accurate and truthful information and does not contain any materials that are insulting, derogatory or defamatory to others. Finally, the CNVL requires companies to obtain permission from the relevant government authorities for any advertising activities. Companies must file for approval and submit their advertisement plans for approval before the advertisement is released to the public. By complying with all these laws, companies can ensure effective and law-abiding advertising in China.
