How does a person file a civil lawsuit?

In Oklahoma, the process of filing a civil lawsuit is a relatively straightforward process. First, the person filing the lawsuit, also known as the Plaintiff, will need to file a Complaint with the appropriate court. Depending on the circumstances of the case, the Plaintiff may also need to file a Summons with the court. The Complaint is a short document that outlines the facts of the case as well as the legal reasons why the Plaintiff believes they are entitled to a remedy. The Summons is a slightly longer document that explains the Plaintiff’s lawsuit to the Defendant, and gives instructions to the Defendant regarding how to respond to the lawsuit. After the Complaint and Summons have been filed, the court must be notified that the Plaintiff has filed a lawsuit. This is accomplished by having the court clerk issue a Notice of Filing.
