What is a temporary injunction in civil law?

In civil law, a temporary injunction is a court order preventing an individual or business from taking a certain action until a legal dispute is resolved. In Oklahoma, a temporary injunction is often requested for a variety of civil actions. A party might request such an injunction if they need protection from someone who might cause damage to their property or to prohibit someone from entering their premises. In Oklahoma, a party can request a temporary injunction by filing a petition with the court. Typically, a hearing is required and both parties must appear before the judge and be heard on the matter. During the hearing the judge will consider the evidence presented by each party, and will then make a ruling on whether or not the temporary injunction will be granted. Temporary injunctions in Oklahoma are limited in scope and duration; usually for a period of no more than 15 days. The purpose of the injunction is to protect the parties involved in the dispute from potential harm that could be caused if their opponent was to take any action. In the event that the temporary injunction is not obeyed, the court can then choose to issue an attachment, meaning that specific assets of the party in disobedience of the court’s order will be attached until the dispute is resolved. In some cases, the court might also choose to impose a fine instead of, or in addition to, issuing an attachment.
