What is a hardship in civil law?
In civil law, a hardship is a situation where a person or a group of people have a disadvantage or suffer a disability due to circumstances beyond their control. In most cases, a hardship can refer to any situation which causes extreme stress or difficulty. For example, a person might experience a hardship due to an illness or injury which prevents them from working, or because they are in arrears with their mortgage payments. In Oklahoma, a hardship is addressed in civil law by allowing the plaintiff to claim relief from certain requirements or obligations. For example, a homeowner in default might be allowed to delay foreclosure to allow time for the mortgage arrears to be paid. This sort of relief is granted through a process of negotiation and agreement between the parties involved. In some cases, a court of law may be involved in determining whether or not a hardship exists. In this situation, the court will weigh the evidence and decide whether or not the hardship is sufficient to warrant relief from the requirements or obligations. Civil law in Oklahoma also allows for a person or group to petition for an order of protection in cases of extreme hardship. This type of order allows the petitioner to be protected from certain kinds of harm or abuse. For example, an order of protection may be granted if a person is being threatened with violence or if they are a victim of domestic violence. Overall, a hardship in civil law is a difficult situation which requires the parties involved to work together to find a resolution. In Oklahoma, the courts and other legal processes may be employed to both determine and address the hardship.
