What is a cause of action in civil law?

A cause of action is a legal claim in civil law. In Oklahoma, a cause of action is a claim made by a plaintiff against a defendant in a civil court. A cause of action is the legal basis upon which a plaintiff might seek to compel a defendant to pay damages or other relief. In order for a plaintiff to have a cause of action, there must be a legally recognized “actionable” wrong. This wrong is usually a breach of contract or a tort. The plaintiff must also be able to prove that the defendant caused the plaintiff to suffer some sort of harm as a result of the wrong. For example, if a person signs a contract for the purchase of a car but never receives it, they may have a cause of action against the seller. The plaintiff has suffered a financial loss due to the breach of contract, and can seek damages for the cost of the car from the defendant. The court system in Oklahoma may also recognize certain civil causes of action even if they are not explicitly written into the law. For instance, wrongful death is a recognized cause of action in Oklahoma and is often brought by surviving family members against a person or entity that may have caused the death of a loved one. In summary, a cause of action is a legally recognized claim that a plaintiff may bring before a court in civil law. This claim must be based on an actionable wrong and the plaintiff must be able to prove that the defendant caused them some sort of harm. In Oklahoma, the court system may also recognize some causes of action even if they are not explicitly written into the law.
