What is a class representative?

A class representative is a person who is chosen to represent a group of people in a class action lawsuit. In California, the class representative is the individual who files the lawsuit on behalf of the group. The class representative is the only person who can enter into a settlement with the defendant and has the authority to accept or reject the settlement on behalf of the entire class. The class representative is responsible for ensuring that all of the class members are adequately represented and protected during the class action litigation process. This includes making sure that the other class members are correctly informed about the process, as well as making sure that their rights are upheld. The class representative is also responsible for ensuring that any settlement that is reached is fair to the class members and is in their best interests. The class representative should have the same interests and be affected by the lawsuit in the same way as the other class members. In California the class representative must also meet the requirements of Rule 23 of the Federal Rules of Civil Procedure. This includes having the capacity to sue, having typicality in respect to the requirements of the class as a whole, and having adequate resources for trial.
