What are class action federal rules of procedure?
Class action federal rules of procedure are the rules that govern a class action lawsuit in the federal court system. A class action lawsuit is a type of legal action in which a large group of people, referred to as a "class", file a joint claim against a defendant. The Class Action Fairness Act of 2005 established class action rules of procedure. It allowed federal judges to hear class action cases that involve over 100 plaintiffs, involve an amount of money in dispute of at least $5 million, or involve claims from citizens of different states. Federal rules for class action lawsuits also state that any plaintiff wishing to participate in a class action lawsuit must be provided with a notice detailing the case, the rights of the class members, and the means of opting out of participating in the lawsuit. Class action lawsuits have a few procedural requirements that must be met. A representative for the class must be designated. This representative acts on behalf of the class in all aspects of the case. Additionally, the judge overseeing the case must certify that the class meets the requirements for a class action lawsuit. The federal class action rules of procedure also state that the proceedings must be conducted in a fair and efficient manner. This includes providing adequate notice to class members and allowing them to opt out of the lawsuit if they wish. There are other procedural rules for class action cases, such as rules concerning discovery and summary judgment. However, the primary rules governing class action cases are the Class Action Fairness Act of 2005 and the federal rules for class action lawsuits.
