What is the difference between a class action arbitration and a class action lawsuit?

Class action lawsuits and class action arbitrations are both legal proceedings brought by more than one plaintiff or claimant against one or more defendants, but there are some key differences between the two. In a class action lawsuit, a group of individuals collectively sue a defendant for a wrongful act. All members of the class action have a stake in the lawsuit, and a single verdict is rendered that is binding for all members of the class. In Kansas, class action lawsuits can be brought under the Kansas Consumer Protection Act, the Kansas Deceptive Trade Practices Act, and the Kansas Fair Business Practices Act. A class action arbitration, on the other hand, is handled outside of the courts and is typically handled by a private arbitration service. In a class action arbitration, each member of the class is allowed to present their case before an arbitrator, and then the arbitrator decides an outcome that is binding on all members of the class. This process is often faster and more efficient than a class action lawsuit, but may lack some of the scrutiny and fairness available in a court system. In Kansas, class action arbitrations can often be found in business-to-business disputes, employment disputes, consumer claims, and other complex litigation cases. Both class action lawsuits and class action arbitrations can be useful tools to protect the rights and interests of individuals and businesses, and the right option should depend on the specific situation.
