What is the difference between a settlement class and a damages class?

A settlement class and a damage class are two different types of classes in a class action lawsuit. Settlement classes are usually brought against a defendant in order to resolve a dispute without going to trial. In a settlement class, the defendant typically agrees to give money or other compensation to the members of the class in exchange for the class members not taking the issue to trial. This type of class action lawsuit is usually used to resolve an issue without the need of a lengthy trial. Damage classes, on the other hand, are usually brought when a class of individuals have suffered an injury or loss from the actions of the defendant and seek compensation for those injuries or losses. In a damage class action lawsuit, the class members usually must prove that they have suffered losses, and the court then will determine an appropriate amount of compensation. Unlike settlement classes, damage classes often require a lengthy trial in order to prove the case and obtain an appropriate amount of compensation. In Alaska, class action lawsuits must meet certain criteria in order to be brought as either a settlement or damages class. Settlement class actions must involve claims with common questions of law or fact, and must be brought on behalf of a large class of people. Damage class actions must involve a matter that is of public concern and must involve similar claims brought by a large number of people. In summary, the difference between a settlement class and a damages class is that a settlement class is used to resolve a dispute without a lengthy trial, while a damages class is used to seek compensation for losses or damages suffered by a group of individuals as a result of the defendant’s actions.
