What types of defenses are available in class action lawsuits?

In class action lawsuits in Alaska, defendants may invoke a variety of defenses in order to avoid liability. Generally speaking, defendants may argue that they did not breach any duty of care or duties of good faith and fair dealing, or that they were not liable in any way for the plaintiff’s alleged harm. Additionally, defendants may attempt to show that the plaintiff’s claim lacks merit or that the plaintiff cannot prove all necessary elements of his or her claim. In addition, defendants may also make a “statute of limitations” defense, which refers to an argument that the plaintiff’s claim was not brought within the time required under the applicable law. Another defense might be an argument of “waiver of claims,” which states that the plaintiff gave up their legal rights with respect to the claim in question. Similarly, defendants may also claim “estoppel,” which is when the plaintiff is precluded from asserting certain rights due to their own prior conduct. Finally, a defendant may make a motion to dismiss the action, arguing that the claim fails to state a claim upon which relief can be granted. The motion to dismiss must be based on the facts and legal arguments available to the defendant. If the motion is granted, the action is usually terminated and the defendant will not be liable to the class.
