What is the difference between a plaintiff class and a defendant class?
A plaintiff class is a group of people who have been wronged by a defendant and have banded together to form a lawsuit against that defendant. In West Virginia, plaintiff classes can be formed when multiple plaintiffs claim similar damages or injuries from the same defendant. Plaintiff classes are formed when a group of people want to sue someone for the same type of wrong. A defendant class, however, is a group of people or entities who are defending themselves against a lawsuit brought by a plaintiff class. Defendant classes can be formed in West Virginia when multiple defendants are sued for the same wrong. In a defendant class, each individual defendant is joined together to form a single defense. All of the members of the defendant class must defend themselves against the suit together in order to be successful. In summary, the difference between a plaintiff class and a defendant class is that a plaintiff class is formed when multiple plaintiffs seek to sue the same defendant, while a defendant class is formed when multiple defendants must join together to fight the same lawsuit. This is a common scenario in class action lawsuits in West Virginia.
