What is the process of civil litigation?

Civil litigation is the process a person or business must go through if they want to sue another person or business for damages. In Hawaii, the process of civil litigation involves filing a complaint with the court, serving the complaint to the defendant, and responding to the complaint. After the complaint is filed, both parties have the opportunity to conduct discovery and review evidence. This is a process in which each party communicates in writing or by deposition with one another to learn more about the case. Afterwards, both parties have an opportunity to negotiate a settlement in an effort to avoid going to trial. If a settlement isn’t reached, the case moves to a hearing or trial where a judge or jury makes a decision based on the evidence presented by each side. The process is completed by the court entering a judgment in favor of one or the other party. In some cases, an appeal can be filed in order to have a higher court review the decision of the lower court. Civil litigation can be a long, complex process.
