What are the penalties for computer crimes?

Computer crimes are crimes committed through the use of computers or electronically distributed technology. In Texas, computer crime laws are outlined in the Texas Penal Code. Penalties for computer crimes vary in severity depending on a variety of factors such as the type of crime committed, prior criminal history and the amount of damage caused. For example, minor computer crimes such as unauthorized access to a computer system can result in a Class B Misdemeanor which carries a penalty of up to 180 days in jail and/or a fine up to $2,000. More serious computer crimes such as copyright infringement may be charged as a 2nd Degree Felony which carries a penalty of up to 20 years in prison and/or a fine of up to $10,000. In addition, a perpetrator of a computer crime such as this may also face charges of civil liability for damages. Finally, the most serious computer crimes such as computer fraud are charged as a 1st Degree Felonies which carries a penalty of up to 99 years in prison and/or a fine up to $10,000 plus restitution for damages. Although each crime carries its own particular penalties, it is important to remember that computer crimes are taken very seriously, especially in Texas. As a result, those found to be in violation of computer crime laws may face stiff penalties including jail time, steep fines, and even the restitution of damages.
