In Mississippi, computer incidents and vulnerabilities must be reported in certain circumstances by law. The Mississippi Data Breach Notification Law, which is found in MS Code Ann. § 75-24-29, requires any holder of personal information to report to a consumer who may have been affected by a security breach. Furthermore, Title 75, Chapter 89 of the Mississippi Code requires operators of gas or electric utilities to have an incident response plan and to report incidents involving unauthorized access to, or alteration or destruction of, confidential information to the Mississippi Public Service Commission. In addition, the Mississippi Department of Information Technology Services is required to establish and maintain a security incident and reporting program. The program would require any state agency that owns or operates a computer system to report any security incident promptly to the Department. This includes any unauthorized access, use, disclosure, disruption, modification, or destruction of a computer system or its information. Finally, the Mississippi Public Records Act requires the state’s government agencies to make certain records available for public inspection and copying. The Act also requires the agencies to retain certain documents which include records that contain information about computer system vulnerabilities.
