In the state of Florida, there are laws concerning the use of computer “bots” or automated trading programs to trade on financial markets. The Florida Uniform Electronic Transactions Act (FUTA) of 1999 is a set of guidelines governing the use of electronic records, signatures, contracts, and other evidence in financial markets. The FUTA states that automated trading programs—or bots—must comply with all applicable securities laws. This means trading bots must meet requirements set by the Securities and Exchange Commission (SEC) and other regulatory agencies. These requirements include things like the disclosure of any automated trading to investors and regulators, the implementation of technology that monitors and protects against potential market abuse or manipulation, and the assurance that the bot is operating in compliance with all applicable laws. In addition, bots must follow the guidelines set out in the Florida Electronic Trading Market Regulation Act (ETMRA) of 2003. All bots must also adhere to guidelines put in place by their owners or operators, as well as those set out by the exchanges or markets they are trading on.
