What is the appellate process for construction disputes?

Appeals for construction disputes in Maryland can be brought to the Maryland Court of Special Appeals. This court is the intermediate appellate court and it hears appeals from the circuit courts and certain state agencies. The process of bringing an appeal to the Court of Special Appeals begins with filing an application for leave to appeal. This application must be filed within 30 days of the judgment or order from which the appeal is taken. The application must explain why the appeal should be heard and provide an explanation of any errors made by the trial court. The filing of the application does not guarantee that the appeal will be heard. The Court will weigh the application to decide if a case should be granted review. If leave to appeal is granted, the appellant can then submit their briefs to the court. In the briefs, an appellant must provide a clear and precise statement of their position, the facts of the case, and what the law requires. The other party then has the opportunity to file a written response in their own brief. Finally, the Court will hear oral arguments and then make a decision on the appeal. The decision can either affirm, reverse, or modify the judgment that was made at the trial court. Once the appeal has been decided, it can be taken to the Court of Appeals of Maryland for further consideration.
