What are the laws governing product warranties?
In Hawaii, the laws governing product warranties are regulated by the Uniform Commercial Code (UCC), which is a set of laws that applies to all states. When it comes to product warranties, the UCC generally requires that sellers must provide any warranties they’ve promised. Additionally, these warranties should be specific and in writing. Any warranties provided must also be compliant with Hawaii’s implied warranty of merchantability, which basically states that any product bought must be fit for its intended use. If the product is not fit for its intended use, then it will be considered defective under this implied warranty. Hawaii also has a law called the Magnuson-Moss Warranty Act, which is designed to ensure that sellers honor any warranties they’ve made. Under this law, any warranties must be clear and easily understandable so that consumers know what they’re buying and have reasonable expectations of what the product can do. In addition to these two laws, Hawaii has several others related to product warranties. For example, the Home Improvement Statute requires sellers of home improvement projects to provide a written warranty that includes certain information about the work that was done. This helps ensure that consumers are aware of what’s included in the warranty and what to expect from the product they’re buying.
