What consumer protections are available for rental housing?
In Hawaii, rental housing consumers are protected by a variety of laws. The Landlord-Tenant Code of the Hawaii Revised Statutes (HRS) provides legal protection for tenants. Landlords must follow all laws regarding rental agreements, deposits, rent, repairs, evictions, and more. According to HRS, landlords must provide tenants with written rental agreements that outline the rights and responsibilities of each party. Landlords cannot charge excessive security deposits or require tenants to maintain the property in a way that is unreasonable. The landlord must return any security deposit to the tenant within 14 days after the tenant moves out. HRS requires landlords to maintain the rental unit in a safe and sanitary condition. This means that the rental unit must meet legal requirements for heat, plumbing, electricity, and other services. If the landlord fails to properly maintain the rental unit, the tenant can pursue legal action. Additionally, Hawaii’s Tenant Protection Law states that landlords cannot begin an eviction until they have given proper and timely notice to the tenant. The notice must include the reason for the eviction and the appropriate amount of time for the tenant to vacate the premises. Tenants have a right to fight an eviction in court if they believe the landlord’s actions are illegal or unreasonable. Overall, the laws in Hawaii provide tenants with various protections as renters. Tenants can always refer to HRS or seek legal advice if they feel their rights as a tenant are being violated.
