Yes, there are a few consumer protections related to the use of intellectual property in Hawaii. Consumers have a right to own, use, and dispose of intellectual property such as copyrights, trademarks, patents, and trade secrets. Under Hawaii’s new Data Privacy and Security Law, consumers also have protection when it comes to the use of their personal information. The law requires companies to have a security plan in place that includes administrative, technical, and physical safeguards for the protection of personal data. In addition, Hawaii’s Unfair or Deceptive Acts or Practices (UDAP) law protects consumers from unfair or deceptive practices related to intellectual property. This law makes it illegal for companies to unfairly or deceptively use intellectual property, such as trademarks or trade secrets, for the purpose of gaining an advantage over competitors or deceiving or misleading consumers. Finally, consumers also have the right to pursue civil action in court in cases of intellectual property infringement. If a company or individual is found to have unlawfully used a consumer’s intellectual property, then the consumer can seek damages and/or an injunction against the offender in order to secure the rightful owner’s rights. All of these consumer protections are important in order to protect consumers’ intellectual property and ensure that these valuable assets are legally protected.
