What are the laws governing product warranties?

In Kansas, product warranties are subject to the Kansas Consumer Protection Act (KCPA). The KCPA states that any supplier who sells a product must guarantee that it is of merchantable quality and that any representations made about the product are true. Suppliers are also required to honor any express warranties given with the product. Express warranties are a promise made by the supplier that the product will work as claimed. If a warranty is included in the product’s packaging or manual, the product must conform to these claims or the supplier must repair or replace the product. Generally, the supplier will repair or replace the product within a reasonable time period. It is important to note that the KCPA also requires any manufacturer’s warranties to be valid in Kansas. Therefore, if the product comes with a warranty from the manufacturer, the warranty is valid despite the fact that the product was purchased in Kansas. Finally, if the consumer believes that their product is not working as it should, they may file a complaint with the Kansas Office of the Attorney General. The Attorney General will investigate the complaint and may take action against the supplier if they find that the supplier is in violation of the KCPA.
