What is the Lemon Law and how does it work?
The Lemon Law in Arizona protects consumers who purchase or lease a new motor vehicle from a dealer in Arizona. It applies to cars, trucks, vans, motorcycles, motorhomes, recreational vehicles, and off-road vehicles. The Lemon Law requires the dealer to repair any defect or condition that substantially impairs the use, value, or safety of the vehicle. If the dealer fails to repair the vehicle after a reasonable number of attempts, the vehicle may qualify as a “lemon” and the consumer may be entitled to a replacement or a refund. In order to make a claim under the Lemon Law, the consumer must provide written notification to the dealer of all the defects which must be in writing. Then the dealer is given a reasonable number of attempts to repair the defective vehicle. If the defect cannot be repaired after a reasonable number of attempts, the consumer can then file a complaint with the Attorney General’s Office. The consumer must provide proof of all attempts to repair the vehicle and all contact with the dealer. The Attorney General’s Office will then investigate the claim and make a determination as to whether the consumer is entitled to a refund or a replacement. If the consumer is determined to be entitled to a replacement or a refund, they will receive a notice from the Attorney General’s Office. The notice will contain instructions on how to proceed and may include the right to a refund of the purchase price plus any associated costs and expenses incurred, such as towing and storage. The Attorney General’s Office should be contacted to determine if a particular vehicle qualifies as a lemon under Arizona’s Lemon Law and to provide further information about the process and requirements.
