What consumer protections are available for rental housing?

In Georgia, renters have legal protection from unfair practices by their landlords and other actions that violate their rights as tenants. The Tenant Protection Act of 2001 provides tenants with the most protection and outlines specific rights and responsibilities for landlords and tenants. The Tenant Protection Act requires landlords to provide their tenants with a written lease that includes the amount of rent due, a description of the premises, any rules governing the premises, and the amount of the security deposit. The Act also prohibits landlords from retaliating against tenants who exercise their rights or demand that their landlord maintain their property. Landlords must also provide habitable premises to tenants and are responsible for any repairs that are required to make the unit livable. The Act also protects tenants from being evicted or having their rental agreement terminated without a legal cause. Landlords must provide proper notice to their tenants before evicting them. Additionally, the landlord must make sure that all security deposits are refunded to the tenant in a reasonable amount of time after their tenancy ends. Finally, the Act requires landlords to keep the tenant’s personal property on the premises safe from damage or destruction. Landlords cannot enter the tenant’s premises without the tenant’s consent, unless there is an emergency or the tenant has given the landlord permission to enter. In the event that a tenant’s belongings are damaged, the landlord must compensate the tenant for the damage.
