Are there consumer protections against price-gouging during emergencies?
In Arizona, there are consumer protections in place against price-gouging during emergencies. During a declared emergency, the Arizona Attorney General is authorized to take action against businesses that seek to take advantage of consumers by charging unreasonably excessive prices for goods and services. This includes price-gouging for food, fuel, lodging, medical supplies, and other goods and services that are needed by consumers during an emergency. The Attorney General may investigate allegations of price-gouging and take appropriate legal action to protect consumers. Price gouging is an unfair and deceptive practice that can result in civil penalties of up to $10,000 per violation. The Attorney General may also seek restitution from businesses found to be in violation of Arizona’s consumer protection laws. In addition to the Attorney General’s authority to enforce price-gouging laws, Arizona consumers are also protected from price-gouging by the Arizona Consumer Fraud Act. The Consumer Fraud Act prohibits unfair or deceptive practices, such as failing to disclose a reduced price or charging an excessively high price. If a consumer believes that a business is engaging in price-gouging during an emergency, they may file a complaint with the Attorney General’s Office for review and investigation.
