Are there consumer protections against price-gouging during emergencies?
In Kansas, consumer protections against price-gouging during emergencies do exist. The Kansas Consumer Protection Act (KCPA) prohibits businesses from charging an unconscionably high or excessive price for goods or services during a declared state of emergency. The KCPA applies to vendors as well as those offering services, such as plumbing, electrical, and construction. Under Kansas law, a business cannot increase prices more than 10% during a declared emergency without providing notice of the increase. If prices are raised, a business must post signs in their establishment with the percentage of the increase, the date it began, and the date it ends. Businesses found to be in violation of the KCPA may be brought to court by the Kansas Attorney General or a county or district attorney. If a court finds a business to be guilty of price gouging, they may impose a fine of up to $25,000 and be required to pay restitution to affected consumers. Ultimately, Kansas residents should contact their local law enforcement or consumer protection agency if they believe they have been victims of price gouging. Businesses are prohibited from taking advantage of vulnerable consumers during emergencies and will be held accountable if they do so.
