What consumer protections are in place for the purchase of used cars?

Nebraska consumers have a number of consumer protections available when purchasing a used car. The Used Car Bill of Rights outlines the rights of the buyer for any used car purchased in the state. According to the Nebraska Department of Motor Vehicles, the Used Car Bill of Rights requires the seller of a used car to provide the buyer with a written warranty that states the car will be mechanically sound for a period of thirty days or three thousand miles, whichever comes first. Additionally, the seller must provide a free and clear title to the car as well as a Vehicle Identification Number (VIN) inspection. The Used Car Bill of Rights also requires the seller to provide the buyer with a disclosure statement, which includes information about the car’s prior damage history and the date of the most recent safety inspection. The Used Car Lemon Law is also applicable to consumers in Nebraska who purchase a used car with a warranty. If a consumer’s car is found to have a defect that substantially impairs the vehicle’s use, value, or safety, and the defect has been reported to the manufacturer within eighteen months of purchase, the manufacturer is required to repair or replace the car at no cost to the buyer. Lastly, the Magnuson-Moss Warranty Act provides additional consumer protection to those who purchase a used car with a written warranty. The Magnuson-Moss Warranty Act states that warranties must be written in clear language and cannot be waived. The Act also requires that information about warranty coverage be included in the sales agreement for any car with a warranty, and the seller must provide the buyer with a copy of the warranty.
