What is collaborative divorce law?

Collaborative divorce law is a legal process that allows couples who are seeking to end their marriage to resolve the issues between them without going to court. This approach is available in North Carolina and requires both spouses to voluntarily agree to participate in the process and to hire their own representation, such as an attorney, during the process. During the collaborative divorce process, the spouses work together with their attorneys to reach a fair agreement on all aspects of their separation, such as child custody, alimony, property division, and more. As part of the process, both spouses and their attorneys sign a collaborative participation agreement which states that they will not pursue legal action in court. This agreement also outlines the process and procedures that will be followed during the process. Furthermore, both spouses and their attorneys agree to remain focused on reaching a mutually beneficial outcome without participating in any type of aggressive or adversarial behavior. The goal of collaborative divorce law is to provide spouses with a less contentious and more cost-effective way to end their marriage.
