How is intellectual property enforced?

Intellectual property (IP) is a legal concept that is used to protect various forms of creative work. In Oklahoma, IP laws are enforced under the federal Copyright Act of 1976, which grants exclusive rights to authors, artists, and inventors of original works. IP protection covers both tangible and intangible items like books, movies, artwork, software, designs, logos, trademarks, trade secrets, and other inventions. The owner of an IP right is allowed to control the use of their work—who can reproduce, distribute, and publicly perform or display it. When an IP violation happens, the owner of the IP right can contact a legal professional or submit a formal notice to the violator demanding that they immediately stop using the IP. If the violator does not comply, the owner of the IP right can file a lawsuit to help them obtain relief, such as monetary damages. The U.S. government also has the authority to take legal action against violators of IP. This includes an investigation of the violation and, if appropriate, filing charges against the offender in a court of law. In order to ensure that IP is protected, it is important for creators to take the necessary steps to obtain the correct protection for their work, including registering it with the applicable federal agency. By properly enforcing IP laws, creators are able to create original works and ensure that they receive due credit for their creativity.
