What is the difference between a breach of contract and a tort?
A breach of contract and a tort are two different legal concepts. A breach of contract occurs when one party fails to fulfill an agreement or promise that was made to another party. This could be anything from not providing services according to a contract or not paying a debt that was owed. In order to prove a breach of contract, the other party must show that the parties had an agreement, that one party did not fulfill their end of the contract, and that they suffered damages as a result. A tort, on the other hand, is a civil wrong that can be committed against another person or party. This is a wrongful act that causes harm to another, either physically or emotionally. The injured party can bring a civil lawsuit to recover damages from the culprit for the damages caused by the tort. Unlike a breach of contract, a tort does not require the presence of a contract between the parties. Torts are based on the concept of fault, so the wrongdoer must have been at fault in the incident to be held liable for the tort. In Arizona, breach of contract and tort law are both governed by the state’s civil code. The laws regarding breach of contract will address the rights of the parties to the contract, what constitutes a breach of contract, and the damages that may be recovered when one party violates the agreement. Tort law will focus on the responsibility of the wrongdoer and the damages that may be recovered as a result of their actions.
