How is employment contract law enforced?

Employment contract law is enforced in Delaware by the Delaware Department of Labor. If an employee feels their contract has been breached or unfair, they can file a complaint with the department. The department will then investigate the complaint and may bring charges against the employer, depending on the outcome of the investigation. The employer could be charged with violating the Delaware Wage and Hour Law, which requires employers to comply with the terms of the contract and pay employees the wages and benefits outlined in the contract. If it is found that the employer has violated the Wage and Hour Law, the department can issue a cease and desist order and issue fines to the employer for non-compliance. The department may also refer the case to the Delaware Attorney General’s Office if the complaint is found to be of a serious nature. The Attorney General’s Office can investigate and file criminal charges against the employer if it is found that the employer has violated the law. In addition, the Department of Labor can refer an employee to a private attorney for legal representation. The employee can then sue their employer in a civil court for any damages they have suffered from the breach of contract. Through this process, the employee can get compensation for their losses and financial damages.
