How is employment contract law enforced?

In North Carolina, employment contract law is enforced by the courts. When an employee brings a claim of breach of an employment contract, the court will look at the language of the contract and any applicable state or federal laws that might apply. If the language of the contract is clear and unambiguous, the court will enforce the contract according to its terms. If the contract is ambiguous, or if state or federal law provides a different interpretation of the contract, the court may modify the contract so that it may be enforced according to the terms both parties intended. The court may also consider any applicable case law that has been established in similar cases. This precedent can be used to interpret the contract and the court can use this interpretation to determine if the contract has been breached. If the court finds that the contract has been breached, it will normally award damages to the party that has been harmed by the breach. The damages award will usually be the difference between the value of the contract performance and the actual performance that was received. However, the court may also award punitive damages in certain cases if it finds that the breach was intentional or done in bad faith. Finally, if the breach of contract was the result of fraud or misrepresentation, the court may award punitive damages in addition to any other damages it might award. This is meant to punish the party who committed the fraud and deter others from committing the same type of fraud in the future.
