Yes, you can file a complaint against a condo association in Texas if you feel they are not following the rules. Texas has a law called the Texas Condominium Act (TCA) which sets out the rules and regulations of condo associations. Under this law, the board of the condo association must act in good faith and with reasonable care. These are called fiduciary duties and they include following the laws as well as the condo association’s governing documents such as the bylaws and rules and regulations. If you feel that your condo association is not following the laws or abiding by its governing documents, you can file a complaint. You can do this either through an informal grievance process or through a formal grievance process. You should talk to your condo association to try and resolve the issue informally before filing a complaint. If your condo association still fails to take action or you disagree with their response, you can file a complaint with the Texas Real Estate Commission (TREC). You should provide any relevant documents and evidence that support your complaint. The TREC will then investigate the complaint and take the necessary action.
